Important Enterprise Income Verification (EIV) System Related Information

SHARING OF EIV DATA WITH OTHER AGENCIES PROHIBITED

The EIV Social Security (SS), Supplemental Security Income (SSI), new hires (W-4), wage and unemployment compensation information contained in the EIV system may only be used for limited official purposes – by owners/agents (O/As) for verifying the employment and income at the time of recertification for tenants participating in one of HUD’s rental assistance programs listed below, by Contract Administrators (CAs) for monitoring and oversight of the tenant recertification process and by the Office of the Inspector General (OIG) for investigative purposes. These programs include:
  • Project-based Section 8
New Construction
State Agency Financed
Substantial Rehabilitation
Section 202/8
Rural Housing Services Section 515/8
Loan Management Set-Aside (LMSA)
Property Disposition Set-Aside (PDSA)
  • Rent Supplement
  • Rental Assistance Payment (RAP)
  • Section 202/162 Project Assistance Contract (PAC)
  • Section 202 Project Rental Assistance Contract (PRAC)
  • Section 811 PRAC
  • Section 236
  • Section 221(d)(3) Below Market Interest Rate (BMIR)

Official use does not include O/As using the EIV data for certifying tenants under the Low Income Housing Tax Credit (LIHTC) or Rural Housing Services (RHS) Section 515 programs since neither the Internal Revenue Service (IRS) nor RHS are a party to the computer matching agreements the Department has with the Department of Health and Human Services (HHS) and with the Social Security Administration (SSA). The fact that there is financing through other federal agencies involved in a particular property under one of the authorized HUD programs does not permit that federal agency to use or view information from the EIV system for certifying tenants for their programs or for monitoring purposes.

TENANT CONSENT FORM HUD-9887 NECESSARY BEFORE EIV DATA MAY BE ACCESSED

Before accessing the employment or income data contained in the EIV system for a tenant, the O/A must make sure there is a current form HUD-9887, Notice and Consent for the Release of Information, signed and dated by the tenant(s), on file. This form must be signed and dated by the head of household, spouse, co-head, regardless of age, and by each family member who is at least 18 years of age, at the time of move-in and at each annual recertification.

Paragraph 7-10 of Handbook 4350.3 REV-1, Occupancy Requirements of Subsidized Multifamily Housing Programs, states that tenants are not required to report when a family member turns 18 years of age between annual recertifications. However, before accessing any employment or income information on an individual who turns 18 between annual recertifications, the O/As must make sure they have the 18 year old sign and date the HUD-9887 consent form as soon as possible after the person turns 18 if employment or income data contained in the EIV system will be accessed for this person.

TREATMENT OF MEDICARE PREMIUMS IN ANNUAL INCOME

When the Medicare premium is paid by the tenant, the gross amount of social security that includes the Medicare premium amount is included in annual income. This will be reflected in EIV when the net benefit amount being paid to the tenant is less than the gross benefit amount and the Medicare premium amount is listed under the Supplemental Medical Insurance. The amount of the Medicare premium is included as a medical expense when calculating the medical expense deduction. NOTE: The O/A must make sure that the Medicare premium amount is listed under the Supplemental Medical Insurance since the difference between the gross and net benefit may include the Medicare premium and/or additional deductions, such as garnishments, Medicare Part D prescription drug plan premiums, which are not listed on the benefit report.

When the Medicare premium is paid by the state or another entity, the gross amount of social security that does not include the Medicare premium amount is included in annual income. In this instance, this will be reflected in EIV when the gross benefit and the net benefit for the tenant are the same. The benefit statement will include the Medicare premium amount, a “Y” in the Buy-In column and a date in the Buy-In Start columns under the Supplemental Medical Insurance. The amount of the Medicare premium is not included in annual income or as a medical expense.

USING EIV DATA CONFERENCE CALL POWERPOINT PRESENTATION POSTED

On March 20, 2008, Headquarters staff held a conference call with the HUD Rental Housing Integrity Improvement Project (RHIIP) Help Desk Representatives, Traditional Contract Administrators (TCAs) and the Performance Based Contract Administrators (PBCAs) on using the data and reports contained in the EIV system. The power point slides used in this presentation are posted as a PDF file on the RHIIP Web site at:
http://www.hud.gov/offices/hsg/mfh//rhiip/mfhrhiip.cfm. O/As are encouraged to download and view this information as it will answer many questions regarding EIV data updates and using, safeguarding and retaining the employment and income information and reports contained in the EIV system.

Affordable Housing's Top Awards Highlight National Communities of Quality®

For 15th Year, NAHMA Lauds Highest-Quality Multifamily Affordable Housing

Alexandria, Va. - The National Affordable Housing Management Association (NAHMA) is recognizing five property owners and/or managers as winners of its 2007 Communities of Quality® Awards. The awards acknowledge excellence in the physical, financial and social condition of federally subsidized properties. Property owners and managers compete also on the basis of the quality of life they offer to residents; the level of resident involvement in community life; and the nature of collaborations with other organizations and agencies that contribute to the betterment of the lives of residents and the larger community.

"Achieving the status of being a Community of Quality® Award winner is very significant in our industry," said Kris Cook, executive director of NAHMA, which represents affordable housing owners and managers nationwide. "Every year the competition gets hotter."

The awards are co-sponsored by The Home Depot SupplyT, a leading supplier of maintenance and renovation products to the multihousing industry.

This year's winners were chosen from among 46 properties that qualified for the competition after achieving National Recognition from NAHMA as a Community of Quality®. This means that they exceeded by 100 points the challenging criteria properties must meet to achieve National Recognition.

NAHMA Announces Grandfather Opportunity for its Certified Professional of Occupancy (CPO) Credential

November 29, 2007 - The National Affordable Housing Management Association announced today that it is offering a unique and limited opportunity for grandfathering into its Certified Professional of Occupancy (CPO) credential program. Specifically, persons who hold a national affordable occupancy designation that is comparable to the NAHMA Certified Professional of Occupancy (CPO) designation may have this designation grandfathered into the CPO program through December 31, 2008.

The CPO is NAHMA's designation developed especially for management professionals involved with properties operated under the 4350.3 Occupancy Handbook of the Department of Housing and Urban Development (HUD). The CPO course is the only comprehensive program covering the entire HUD Handbook 4350.3, including the latest revisions. PROTOCOL FOR SUBMITTING QUESTIONS

ON OCCUPANCY RELATED ISSUES

In an effort to provide quick and complete responses to occupancy related questions or questions relating to requirements addressed in HUD Handbook 4350.3 REV-1, Occupancy Requirements of Subsidized Multifamily Programs, the following communication protocol should be followed:

1. Owners, management agents, on-site staff, etc. whose contract(s) is being administered by a Performance Based Contract Administrator (PBCA) or Traditional Contract Administrator (TCA) should direct their question(s) to the PBCA or TCA. PBCAs and TCAs who need additional guidance and/or clarification in order to respond to the owner et all should contact the appropriate HUD field office and the designated point of contact

2. Owners, management agents, on-site staff, etc. whose project(s)/contract(s) is being administered by a HUD Program Center or Hub, should direct their questions to the appropriate HUD field office. HUD field office staff will follow their offices established protocol for responding to occupancy related questions.

3. Other HUD business partners, such as trainers of the occupancy requirements addressed in Handbook 4350.3 REV-1, should contact the HUD Program Center or Hub in their locality for assistance.

4. Only after the above established protocol is followed and a response to the question(s) cannot be provided by HUD field office staff should the question be sent via email to diane.r.hooten@hud.gov at HUD headquarters for response or resolution.

5. Upon receipt of the response from HUD headquarters, HUD field office staff will provide the response or resolution to the entity that submitted the question.

HAVE YOU SIGNED UP FOR ACCESS TO ENTERPRISE INCOME VERIFICATION (EIV)?

HUD encourages owners/management agents (O/As) who have not applied for access to the EIV system, to do so. EIV is a tool that provides O/As access to income information for their tenants for use at recertification. EIV currently contains social security benefit information. However, starting in early January 2008, wage, W-4 (new hires) and unemployment benefit information will also be available. Instructions for obtaining access to EIV are posted on the Multifamily EIV web site at: http://www.hud.gov/offices/hsg/mfh//rhiip/eiv/eivhome.cfm#top.

RHIIP TIP:

Owners must review, and if necessary revise, their Affirmative Fair Housing Marketing Plan every five years or when the local Community Development jurisdiction’s Consolidated Plan is updated.

See Paragraph 4-12.F of HUD Handbook 4350.3 REV-1, Occupancy Requirements of Subsidized Multifamily Housing Programs, for further guidance on updating the marketing plan.

Mark to Market Revisions
Issued 11/28/07:

HUD has released a final rule, “Implementation of Mark-to-Market Program Revisions.” The notice provides the following summary of the rule, which takes effect on December 26, 2007:
“Based on statutory changes and HUD's technical operational experience in administering the program, this final rule implements a number of changes to the Mark-to-Market (M2M) program, HUD's mortgage restructuring program for FHA-insured projects with project-based Section 8 assistance, to facilitate processing. Unlike the M2M proposed and final rules addressing renewal of expiring Section 8 project-based assistance contracts that HUD published on January 12, 2006, this rule addresses a range of administrative and programmatic issues other than the project-based assistance contracts.”

Specific changes made by this rule include:

  • Removal of references to the Office of Multifamily Housing Assistance Restructuring (OMHAR), which was replaced by the Office of Affordable Housing Preservation (OAHP) as of October 1, 2004.
  • Transfer Fee Exemption. The regulation is clarified “to provide for a fee exemption for transfers that are contemporaneous with the restructuring of a mortgage pursuant to a restructuring plan, rather than for transfers ‘in connection with’ a restructuring plan.”
  • Revised Tenant Endorsement Procedure. Per HUD,
    “A purchaser will now only be required to hold one informational meeting, but may hold additional meetings as necessary. Tenant endorsement will be based upon a potential priority purchaser receiving a majority of the tenant heads of household's written endorsement. Those tenants who do not attend the informational meeting, or any subsequent meeting, may be directly contacted by the purchaser to collect their written endorsement. Purchasers who are unable to obtain the majority of tenant heads of household's written endorsement after undertaking reasonable efforts will be able to submit a request, in writing, to HUD. Based upon the information and explanation contained in the request, HUD will make a determination whether or not to grant tenant endorsement to a purchaser based on a lower percentage of tenants' written endorsement.”

Deadline Fast Approaching for 2007 Communities of Quality Awards Submissions
Issued 11/05/07:

November 16, 2007 is the submission deadline for entries to the National Affordable Housing Management Association’s (NAHMA) 2007 Communities of Quality Awards program, which recognizes outstanding property management companies providing the highest possible quality of safe, affordable multifamily rental housing in communities around the country.

NAHMA is also pleased to announce that this year’s Communities of Quality® (COQ) Awards Program will again be sponsored by HD Supply Multifamily Solutions, a leading supplier of maintenance and renovation products to the multi-housing industry.

COQ awards entry materials should be mailed to NAHMA by November 16, 2007, c/o NAHMA COQ Awards Entry, 400 N. Columbus Street, Suite 203, Alexandria, VA 22314. Award winners will be notified in early January 2008 and will receive their awards in a special ceremony at the NAHMA 2008 winter meeting in Washington, DC, on Monday, March 10.

Now in its 15th year, the awards competition will include five categories:
* Exemplary Family Development
* Exemplary Development for the Elderly
* Exemplary Development for Residents with Special Needs
* Exemplary Development for Single Room Occupancy Housing
* Outstanding Turnaround of a Troubled Property

At the same time, a new COQ Corporate Partner Designation has been created for management companies that have had at least 50 percent of their property portfolio accepted into the COQ National Recognition program.

The new Corporate Partner designation recognizes truly outstanding accomplishment and was created specifically to honor management companies that successfully maintain a significant portion of their properties at the high standards of the COQ National Recognition program. The portfolio calculation can be based on either number of units or number of properties managed in the company’s affordable portfolio and is self-reported.

“It publicly declares that these companies are among the finest managers of affordable multifamily housing in the industry,” said NAHMA President Michelle Norris, NAHP-e, SHCM.

Also available at the website is an updated COQ Recognition Program application that includes special consideration for small property participation in several key categories. How to Enter the COQ Awards Program

Step One – Become a Nationally Recognized Community of Quality Property


To enter the 2007 Communities of Quality® Awards competition, a property must first apply for and achieve National Recognition as a NAHMA Community of Quality. To earn National Recognition, a property must meet the minimum required point total of each of the six categories designated under the program (Inspections; Financial Management; Employee Credentials; Programs and Services; Endorsements; and Photographs and Reports) as well as earn an overall total minimum of 225 points. To be eligible to enter the 2007 Communities of Quality® Awards competition, a property must have scored a minimum of 325 points on its National Recognition application (see Step Two for more details for properties that have scored 325 points on past applications).

Detailed application information and submission materials for the NAHMA Communities of Quality® National Recognition program are available at the NAHMA website at www.nahma.org (please click on the Communities of Quality® or COQ navigation links).

If your property initially received less than 325 points when your COQ National Recognition application was first submitted to NAHMA, you may elect to update this original application to earn more points if you have made improvements to your property since then. Simply photocopy your original COQ application (application only, not original supporting documents), and use a colored marker and highlighter to edit the form and indicate where changes have been made and new points should be awarded. Please send the updated application – and documentation that supports the edits made – directly to NAHMA at the address above, with a check payable to NAHMA for $25 (record administration fee). Please note that this limited score updating process does not impact the requirement that every COQ property must submit a complete renewal application every two years from the date of entry into the program; renewal applications are available on our website.

Step Two – If You’re Currently Nationally Recognized – You’re Ready to Enter

If your property has earned National Recognition status as a NAHMA Community of Quality® -- and received 325 or more points on the National Recognition application – then you’re ready to enter the 2007 Communities of Quality® Awards competition! (Properties that competed in past COQ Awards program but did not win are invited to reapply for the 2007 awards program; 2006 award winners are not eligible to re-compete.)

Step Three – Prepare and Submit Entry Materials

Your COQ awards competition entry materials will consist of the following:

1) The National COQ Recognition Program application you have already submitted (you do not need to resubmit a copy of the application; NAHMA will refer to the copy it has on file)

3) An Essay of 500 to 1500 words, outlining the outstanding features and/or aspects of the property, and why it should be selected by the judges as an award winner; and

The Judging Process

To conduct the judging, NAHMA will assemble an independent panel of representatives from the affordable housing arena, including government, academia and trade associations, to review the entry materials. Award winners will be notified in early January 2008, and will receive their awards in a special ceremony at the NAHMA 2008 winter meeting in Washington, DC, on Monday, March 10.

Benefits of Participation

Properties that earn the NAHMA Communities of Quality® National Recognition receive the following benefits:
A congratulations letter and certificate
A draft press release for use with local media
A draft letter for sending to Congressional representatives
Guidance on how to use the COQ trademark in promotional materials
A free subscription to NAHMA News (a $100 value)
A listing in the National Registry of Communities of Quality® on NAHMA’s website
A brochure offering a variety of COQ logo materials available for purchase for local marketing efforts (such as banners, golf shirts, pins, hats, etc.)

REQUEST FOR NOMINATIONS FOR FOURTH ANNUAL NAHMA INDUSTRY AWARDS


NAHMA’s Fourth Annual Industry Awards Reception will be held on Monday, March 10, 2008, at the Renaissance Washington Hotel, in Washington, DC, in conjunction with NAHMA’s Winter 2008 meeting.

At this time, we are inviting nominations for NAHMA Industry Awards in three (3) categories. Nominations are due to NAHMA by Friday, Nov. 9, 2007.

Applications will be forwarded to our Nominating Committee for review, and award winners will be announced via press release in January 2008, and will be presented at the Awards Reception on March 10, 2008.

To nominate someone for any of the following three awards, please respond by email and let us know --
-- which award you are nominating the person for
-- why you think the person should be the award winner, including specific accomplishments supporting your recommendation. This section should be a minimum of 100 words up to a maximum of 1500 words.

1) NAHMA Industry Statesman Award
Given annually to a NAHMA Executive Council member who is either in or nearing retirement, in recognition of many years of outstanding leadership and service to NAHMA.

2) NAHMA Industry Achievement Award
Given annually to a NAHMA Executive Council member who has contributed significant or noteworthy leadership or contribution to NAHMA within the past year or two.

3) Industry Partner Award
Given annually to a government agency or other affordable housing organizational partner that has made a significant contribution to the cause of affordable housing in the previous year.

Three other awards that will also be presented at the Winter meeting will be the --

NAHMA Membership Recruitment Award -- Given annually to a NAHMA Executive Council member who leads in new member recruitment for the previous 12-month period (based on data maintained by NAHMA staff)

NAHMA Communities of Quality Award -- Given annually to a NAHMA Executive Council member who has the most properties listed on the NAHMA National Recognition Program COQ Registry (based on data maintained by NAHMA staff)

NAHMA Presidents Award -- Given annually by NAHMA’s President for outstanding leadership or other contribution to NAHMA and the affordable multifamily housing industry (to be named by NAHMA President Michelle Norris).
